Expert Witness

Bruce Silverman has been designated as an expert witness more than 70 times on cases involving marketing, Lanham and Robinson-Patman Act violations such as unfair competition and deceptive/false/misleading advertising, trademark infringement, branding, celebrity endorsements, publicity rights and advertising industry custom and practice. He has been deposed more than 30 times, and has testified numerous times in Federal Court, State Court, at arbitrations and before the Copyright Royalty Judges of the Library of Congress.

Bruce was the creative advertising expert witness for the plaintiffs in the Toyota Unintended Acceleration Marketing, Sales Practices and Products Liability class action, which settled in December 2012 for $1.1 billion. Other notable cases include Concept Chaser Co., Inc. v. Pentel of America, which resulted in a $32.5 million jury verdict for his client; Zooey Deschanel v. Steven Madden Ltd. and Kohl’s Department Stores; California Department of Parks and Recreation v. Stephen Harper and the Malibu Pier Company; FLIR Systems, Inc. v. Fluke Corporation; and State of California v. R. J. Reynolds Tobacco Co.
